Costs awarded to defence after auxiliary police acquitted of common assault charge

Mr Shah, Mohammed Jawadullah and Ms Chu, Wendy WY successfully defended a Common Assault charge laid against an auxiliary police officer following allegations made by his wife concerning an incident at their residence.

Following a 4-day trial, the defence demonstrated that the complainant’s testimony was fundamentally unreliable. Counsel successfully highlighted material inconsistencies in her account and adduced evidence of ulterior motives connected to matrimonial separation and residency rights.

The Magistrate found that the Prosecution had failed to satisfy the standard of proof beyond reasonable doubt. The court handed down a full acquittal on 13 August 2026 and made an order for defence costs in favour of the defendant.
